Southall & Turner to John W. Anderson, 1885

Nelson County, Virginia Deed Book 22, p. 592-593

Whereas John W. Anderson on 28th April 1882 bought from Robert Whitehead and S.V. Southall Commissioners of Sale under decree of October 1881 in Southall Receivers &c vs. Timberlake &c in the Circuit Court of Albemarle, a tract of land in Nelson County containing thirty eight & 3/8 acres, more or less and about four miles of Afton Depot, for Eleven hundred & Eighty dollars, which sale was confirmed by decree of the Circuit Court of Albemarle rendered in Southall Receiver vs. Timberlake &c on the 10th day of May 1882. And whereas the said Circuit Court of Albemarle by decree of 16th May 1883, in the cause aforesaid appointed S. V. Southall a Commissioner to convey with special warranty to said Jno. W. Anderson the said tract of 38-3/8 acres, more or less, as soon as he the said Anderson fully paid for said land, such conveyance to be at the cost of the fund in this cause; And whereas the said Anderson has fully paid for said 38-3/8 acres of land; Now, therefore, this deed made this 13th day of May 1885 between said S.V. Southall, Commissioner as aforesaid of the first part, Wm. H. Turner of the second part, and said John W. Anderson of the third part, Witnesseth: That the said S.V. Southall, as Commissioner aforesaid, hereby grants and conveys with special warranty the said thirty eight & 3/8 acres of land, more or less, unto the said Jno. W. Anderson. And the said Wm. H. Turner hereby grants unto said Jno. W. Anderson, his heirs, & assigns, the right of way from said Anderson’s sixteen acres of mountain land (part of said 38-3/8 acres) through said Turner’s Mill Tract to said Anderson’s twenty two acres (rest of 38-3/8 acres) where said Anderson resides, said right of way being the same now used by said Anderson between said 16 & 22 acres.

I, R.H. Wood, a Notary Public for Albemarle County, Virginia, do certify that S.V. Southall, Comm., whose name is signed to the foregoing deed, dated 13th May 1885, has acknowledged the same before me in my County aforesaid.

I, Jno. S. McClain, a Justice of the Peace for Nelson County Virginia, do certify that Wm. H. Turner whose name is signed to the foregoing deed, dated 13th May 1885, has acknowledged the same before me in my County aforesaid.
