Daniel & Malinda (Witt) Wade to Robert P. Rhodes, 1848

Nelson County, Virginia Deed Book 12, p. 250

—————————- doth grant, bargain and sell unto the said Robert P. Rodes and to his heirs and assigns forever, a certain tract or parcel of land lying in the County of Nelson, adjoining lands of David T. Witt (formerly Joseph B. Matthews). Beginning at a Dogwood on the bank Ruby Creek, thence with his line to a pine, a corner of said David T. Witt’s land, thence running with Martha Smith’s line to a poplar, a corner to Nathan Harris’ land, thence with Nathan Harris lines to William Stewartson’s line [Stewardson] (formerly Terisha Turner Jr) and with his the said Stewartson’s lines to Ruby Creek, thence with the lines of William B. Sims and Robert F. Sims, and the lines of the heirs of John M. Martin decd, formerly Cornelius Merrill decd, to the beginning. Containing one hundred and forty three acres, be the same more or less, with all the appurtenances thereon belong. To have and to hold the said one hundred and forty three acres of land and premises, with all and singular the appurtenances thereon to belonging, unto the said Robert P. Rodes, and to his heirs and assigns forever. And the said Daniel Wade and Malinda his wife, for themselves, their heirs, executors and administrators, doth hereby covenant and agree to and with the said Robert P. Rodes, his heirs and assigns, that they the said Daniel Wade and Malinda his wife, the before mentioned tract of land and premises with all its appurtenances, unto the said Robert P. Rodes, and to his heirs and assigns against the claim of themselves, their heirs and all persons claiming by or through them by these presents forever defend. In witness whereof, they have hereunto set their hands and affixed their seals the day and year first above written.

Nelson County to wit–

We William Faber and William T. Roberson Justices of the Peace in the County aforesaid, and the State of Va. Do hereby certify that Malinda Wade, the wife of Daniel Wade, parties to a certain deed bearing date on the 29th day of March 1848 and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privily and apart from her husband, and having the deed aforesaid fully explained to her, she said the said Malinda Wade acknowledged the same to be her act and deed, and declared that she had willingly signed, sealed and delivered the same and that she wished not to retract it. Given under our hands and seals this 29th March 1848.

We William Faber and Wm J. Robertson Justices of the Peace in the County aforesaid, in the State of Va. do certify that Daniel Wade, a party to a certain deed bearing date the 29th day of March 1849 and hereunto annexed, personally appeared before us in our County aforesaid, and acknowledged the same to be his act and deed, and desired us to certify the said acknowledgment to the Clerk of the County Court of Nelson County in order that the said deed may be recorded. Given under our hands and seals this 29th day of March 1848.

At a Court held for Nelson County the 24th day of April 1848. This deed was returned into said Court, duly certified by Justices of the Peace for the County of Nelson, and together with the relinquishment of dower of Mrs. Malinda Wade, also returned duly certified and ordered to be recorded.
