THIS DEED, made and entered into this 31st day of March, 1945, by and between Bessie Anderson Pugh, party of the first part, and Everett Plunkett Anderson, James David Anderson and Alma Virginia Anderson, parties of the second part,

  • -WITNESSETH-

That for and in consideration of the sum of Three Thousand ($3000.00) Dollars, of which sum Five Hundred ($500.00) Dollars is paid in cash, the receipt of which is hereby acknowledged, the balance of the purchase money to be secured by a contemporaneous deed of trust, the said party of the first part doth hereby Grant and Convey, with General Warranty of Title unto the said parties of the second part, the following described real estate:

A certain tract or parcel of land supposed to contain fifty-seven (57) acres, more or less, being in the Rockfish Magisterial District of Nelson County, Va., which was conveyed to J. T. Anderson by deed dated August 5, 1906, and recorded in the Clerk’s Office of the Circuit Court of Nelson County, Va., in Deed Book 58, at page 44, and acquired by Bessie Anderson Pugh, party of the first part by deed from Harry R. Anderson and others, dated February 23, 1943, and recorded in the Clerk’s Office at the Circuit Court of Nelson County, Va. In Deed Book 71, page 475; and by deed from J.T. Coleman, Jr., Special Commissioner in the chancery suit of Edith A. Anderson et als vs. Harry R. Anderson et als, by deed dated July 1, 1943, and recorded in the Clerk’s Office of the Circuit Court of Nelson County, Va., in Deed Book 71, at page 535.

THIS DEED, made and entered into this 31st day of March, 1945, by and between Everett Plunkett Anderson (widow), James David Anderson (single) and Alma Virginia Anderson (single), parties of the first part; J.T. Coleman, Jr., Trustee, part of the second part, and Bessie Anderson Pugh, party of the third part,

  • -WITNESSETH-

That for and in consideration of the sum of Five ($5.00) Dollars, cash in hand paid by the party of the second part to the parties of the first part, the receipt of which is hereby acknowledged, the said parties of the first part do Grant and Convey, with General Warranty of Title, unto the said J.T. Coleman, Jr., Trustee, party of the second part, the following described real estate:

A certain tract or parcel of land supposed to contain fifty-seven (57) acres, more or less, being in the Rockfish Magisterial District of Nelson County, Va., which was conveyed to J. T. Anderson by deed dated August 5, 1906, and recorded in the Clerk’s Office of the Circuit Court of Nelson County, Va., in Deed Book 58, at page 44, and acquired by Bessie Anderson Pugh, part of the third part, by deed from Harry R. Anderson and others, dated Feb. 23, 1943, and recorded in the Clerk’s Office of the Circuit Court of Nelson County, Va., in Deed Book 71, page 475; and by deed from J.T. Coleman, Jr., Special Commissioner in the chancery suit of Edith A. Anderson et als vs Harry R. Anderson et als by deed dated July 1, 1943, and recorded in the Nelson County, Va., in Deed Book 71, page 535; and the same real estate this day conveyed to the parties of the first part by Bessie Anderson Pugh, the deed conveying the same to be recorded along with this Deed of Trust.

BUT UPON THIS TRUST: to secure to Bessie Anderson Pugh, party of the third part, the payment of the sum of Two Thousand Five Hundred ($2500.00) Dollars, with interest at the rate of 5% per annum, payable semi-annually, evidenced by one note bearing even date with this deed, made, executed and signed by the parties of the first part and payable to Bessie Anderson Pugh five years after date, with interest at the rate of 5% per annum, payable semi-annually.

This deed is executed pursuant to the provisions of Section 5167 of the Code of Virginia, as amended, and in short form as therein set out as follows:

Subject to call upon default.

Insurance required $_______________.

Anticipatiens in whole or in part permitted.

Homestead exemptions waived.

Extensions and renewals permitted.

Deferred purchase money.

5% commission on gross proceeds of sale.
